As we all know there is a smoking ban in certain public places in the UK. Some organisations, however, have gone much further than others in enforcing this. Some NHS trusts are saying that employees can't smoke in their own cars when going about on trust business, all well and good but this is verging on an infringement of human rights - if you don't want people to smoke when travelling you should really provide them with a company vehicle.
Now let's take it even further - my local Mental Health Trust have banned smoking on their premises (despite having a legal 18 month grace period to introduce the changes in phases) and have included the grounds of the hospital in their ban. Many mental health patients smoke, quite a few of these are detained under the Mental Health Act to protect others from harm and therefore need to have a very close eye kept on them. If you are going to have to escort them to the front gate of the hospital and into the street every time they want a cigarette what's going to happen? Well it's obvious isn't it - someone will abscond and commit some terrible crime and then the noisy campaigners who want to lock up all people with mental illness and throw away the key will have a field day and the draconian measures they are lobbying for will become law.
Now who was it said the law is an ass? Clearly they had never met an NHS Trust Board...
